23 Criminal history reports
To decide if a person is disqualified from becoming or continuing as the commissioner, or becoming the acting commissioner, the Minister may ask the police commissioner for—
a written report about the person’s criminal history; and
a brief description of the circumstances of a conviction or charge mentioned in the person’s criminal history.
However, the Minister may make the request only if the person has given the Minister written consent for the request.
The police commissioner must comply with the request in relation to information in the police commissioner’s possession or to which the police commissioner has access.
Before using information obtained under this section, the Minister must—
disclose the information to the person; and
allow the person a reasonable opportunity to make representations to the Minister about the information.
