160 Person may apply for assistance
The person can not apply, under the repealed legislation, for the payment of an amount mentioned in section 159(1)(a) after the commencement.
However, the person may apply for assistance.
The application for assistance must be made—
if the person is a Criminal Code applicant and the relevant event happened 2 years or more before the commencement—
if the person was an adult when the relevant event happened—within 1 year after the commencement; or
if the person was a child when the relevant event happened—before the later of the following—
the applicant turns 21;
the end of 1 year after the commencement; or
in any other case—
for a person who was an adult when the relevant event happened—within 3 years after the relevant event; or
for a person who was a child when the relevant event happened—before the person turns 21.
However, the scheme manager may, under section 54(2), extend the time for making an application for assistance under this section.
This section applies despite the Acts Interpretation Act 1954, section 20.
In this section—
Criminal Code applicant means a person to whom section 159(1)(a)(ii) applies.
