185 Purpose and application of sdiv 2

(1)

This subdivision helps the State to recover from a person—

(a)

an amount paid by the State under section 32 of the repealed Act in relation to a compensation order made under section 24 of that Act against the person; orNote—

See section 38 of the repealed Act and section 184 for the State’s subrogation rights in relation to the compensation order.

(b)

an amount paid by the State under section 663C of the repealed Criminal Code chapter in relation to an order made under section 663B(1) of that chapter against the person; orNote—

See section 663E(2) and (3) of the repealed Criminal Code chapter and section 184 for the State’s subrogation rights in relation to the order.

(c)

an amount payable to the State under—

(i)

a repayment order made under section 27 of the repealed Act against the person; or

(ii)

an order made under section 38(5) of the repealed Act against the person.

(2)

This subdivision provides a way for the State to recover an amount payable under an order mentioned in subsection (1) as an alternative to enforcing the order.

(3)

This subdivision applies in relation to an amount mentioned in subsection (1)—

(a)

whether the amount was paid or became payable before or after the commencement; and

(b)

whether or not the order in relation to which the amount is payable has been filed in a court for the purpose of enforcing the order.
