73 Examinations

(1)

The government assessor may—

(a)

ask an applicant for victim assistance to undergo an examination by a health practitioner nominated by the assessor so that a report of the examination can be given to the assessor under this section; and

(b)

ask the relevant person to give the government assessor consent to obtain the report of the examination from the health practitioner who conducts the examination.

(2)

If the relevant person gives consent as mentioned in subsection (1)(b), the government assessor may ask the health practitioner who conducts the examination under subsection (1)(a) to give a report of the examination to the government assessor.

(3)

A health practitioner who is asked by the government assessor to give the assessor a report of an examination conducted under subsection (1)(a) may give the assessor a report of the examination.

(4)

A report given under subsection (3)—

(a)

must be in the approved form; and

(b)

may include another document the health practitioner considers should be read with the report.

(5)

The giving of a report under this section by a health practitioner is authorised despite any other Act or law, including a law imposing an obligation to maintain confidentiality about the examination.

(6)

The government assessor may stop considering the applicant’s application for victim assistance until the government assessor receives a report of the examination requested under this section.
