80 Taking water using particular existing overland flow works authorised
This section applies to the owner of land on which existing overland flow works are situated, other than works for taking only the overland flow water that may be taken under section 79(2)(a) to (d).
The owner may continue to use the existing overland flow works to take overland flow water for 1 year after the amendment day.
Also, if the owner gives the chief executive notice of the existing overland flow works, in the approved form, and any further information reasonably required by the chief executive about the works, the owner may continue to use the works to take overland flow water after the notice and information are given.
In this section—
amendment day means the day the Water Amendment Plan (Burdekin Basin) 2019 commences.
