35 Interference with water for the provision of a pumping pool
This section applies if the proposed interference with water is to provide a pumping pool to enable water to be taken under an authorisation.
The proposed storage capacity of the pumping pool must not be greater than the capacity required to enable the pump to function properly while minimising the impact the proposed interference may have on the following—
in-stream water levels;
a matter mentioned in section 34(4)(b).
In deciding the application, the chief executive must also consider if there is an alternative method available for providing for the operation of the pump that would have a lesser impact on any of the matters mentioned in subsection (2).
