77 Limitations on interference with water
The water licence may be granted only if the purpose of the proposed impoundment is 1 or more of the following—
to store water taken under an authorisation for stock or domestic purposes;
to provide a pumping pool to enable water to be taken under an authorisation;
to provide improved security for town water supplies taken under an authorisation;
to satisfy the requirements of an environmental authority issued under the Environmental Protection Act 1994.
However, the water licence may also be granted if—
the proposed impoundment is related to a proposed water licence to take water that is allocated under the processes mentioned in section 48(2) or (3); or
the proposed impoundment is related to a water licence to take water that is allocated under the process mentioned in repealed section 48(1); or
the impoundment was in existence immediately before 31 December 1999.
In this section—
repealed section 48(1) means section 48(1) as in force from time to time before the commencement.
