Weapons Act 1990

This section applies if—

a police officer directs an individual under section 141Q(2)(d) to accompany a police officer to a place; and

the individual is to be transported by a police officer to the place.

Before the individual is transported to the place, a police officer may—

search the individual for anything in the individual’s possession that may be used to cause harm to the individual or another person; andNote—See the Police Powers and Responsibilities Act 2000, chapter 20, part 3 for safeguards that apply to a search under this paragraph.

direct the individual to leave at the individual’s current location a thing found in the search that may be used to cause harm to the individual or another person; and

seize a thing found in the search that the police officer reasonably suspects is evidence of the commission of an offence.

A thing seized under subsection (2)(c) is, for the Police Powers and Responsibilities Act 2000, section 622, taken to have been seized under that Act.
