22 Chief executive’s responsibility on application for transfer of licence
The chief executive must deal with an application for the transfer of a licence as if the proposed transferee were an applicant for a licence.
The chief executive may transfer the licence only if the proposed transferee is a person to whom a licence could be granted.
Example—
The chief executive may only approve the application if the requirements of relevant sections of this Act have been complied with, including, for example, sections 9, 11, 12 and 13.
On the transfer of the licence, the transferee becomes the licensee and—
has the authority given by the licence to the licensee; and
is subject to the obligations imposed by this Act and the licence on the licensee.
