8 Establishment, responsibilities and powers
The Transition Council of Adelaide University is established.
The Transition Council constitutes the governing body of the University until—
unless paragraph (b) applies—31 December 2026; or
a designated day (which may be a day occurring after 31 December 2026) if that designated day is declared by proclamation made before 31 December 2026.
A designated day may only be declared under subclause (2)(b) on the recommendation of the Minister after a request by the Transition Council.
On the day that applies under subclause (2)—
the Transition Council is dissolved; and
the Council of the University constituted under section 14 commences as the governing body of the University.
The Transition Council has the following responsibilities and functions:
to oversee the transition from tertiary education and research being provided and conducted by The University of Adelaide or the University of South Australia to being provided and conducted by Adelaide University;
to prepare Adelaide University so that it can commence providing courses and other tertiary education programs under this Act and then to continue to act as the governing body of the university until the Council of the University commences as the governing body of the University as contemplated by subclause (4)(b);
the responsibilities and functions—
assigned to the Transition Council under the other provisions of this Schedule; or
assigned to the Council of the University under the other provisions of this Act; or
prescribed by regulations under clause 39;
to engage with the staff and students of The University of Adelaide and the University of South Australia in exercising its other responsibilities and functions under this subclause.
Without limiting any other provision (but subject to the other provisions of this Schedule)—
the Transition Council may exercise all the powers of the Council of the University under this Act; and
until the Transition Council is dissolved, a reference to the Council in the other provisions of this Act, other than this Schedule, will be taken to be a reference to the Transition Council (and a reference to a member of the Council will be taken to be a reference to a member of the Transition Council).
