Power of councils to accept conveyance of cemetery or natural burial ground land from trustees
48 Power of councils to accept conveyance of cemetery or natural burial ground land from trustees
The trustees of land held on trust for a cemetery or natural burial ground may convey it to the council in whose area the land is situated if the council is willing to accept the trust.
If a council accepts a trust, the council will hold the cemetery or natural burial ground on the original trusts or such of the trusts as are applicable.
The trustees are, from the time of the conveyance, discharged from the trusts.
A council must not accept a conveyance of a cemetery or natural burial ground under this section if, under the trusts on which the council will hold the cemetery or natural burial ground, the use of the cemetery or natural burial ground is confined to the interment of the remains of deceased persons who belonged to a particular religion.
