1 Calling in submittable publications for classification
If—
the
National Director has reasonable grounds to believe that a publication is a submittable publication; and
the publication is being published in South Australia, or the National
Director has reasonable grounds to believe that it will be published in South Australia, the
National Director may, by notice in writing given to the publisher of the publication, require the publisher to submit an application for classification of the publication, or of subsequent issues of the publication, by the National Board.
The
National Director must cause notice of a decision under subclause (1) to be published in the Commonwealth of Australia Gazette.
A person to whom a notice under this clause is given must, within three business days after receiving the notice, comply with the notice.
Maximum penalty: $5 000.
Expiation fee: $315.
It is a defence to a prosecution for an offence against subclause (3) to prove that the defendant did not intend—
to publish the publication in South Australia; or
to cause, authorise, permit or license the publication to be published in South Australia.
