25 Prohibiting a person from involvement in the dangerous goods transport industry
If a person is convicted of an offence involving an aspect of the transport of dangerous goods, a court may, after taking into account the matters referred to in subsection (2) and other matters considered relevant by the court, in addition to imposing any other penalty, order that the person be prohibited, for a specified period, to the extent specified by the court, from involvement in the transport of dangerous goods.
The matters to be taken into account by a court under subsection (1) are—
the person's record in the transport of goods; and
any prior convictions of the person relating to dangerous goods; and
the circumstances surrounding the commission of the offence for which the person is being sentenced.
A person who contravenes an order under this section is guilty of an offence.
Maximum penalty:
In the case of a body corporate—$250 000.
In any other case—$50 000 or imprisonment for two years, or both.
