63AB Compliance with certain code provisions under Essential Services Commission Act 2002 and requirements of regulations
A
NERL retailer must comply with—
code provisions as in force from time to time under the Essential
Services Commission Act 2002 specified in, or in a manner prescribed by, the regulations; and
any requirements imposed under the regulations, relating to—
technical or safety requirements or standards; and
any scheme relating to energy productivity; and
any other matter related to the sale and supply of electricity by retail specified in the regulations.
Maximum penalty: $1 000 000.
An offence against subsection (1) may be prosecuted as an indictable offence or a summary offence at the discretion of the prosecutor but, if prosecuted as a summary offence, the maximum penalty that may be imposed is a fine not exceeding $20 000.
