79 Assurances
The
Responsible authority may accept an assurance given by—
a trader; or
a director of a body corporate that is a trader, in connection with a matter in relation to which the Responsible authority has a power or function under this Act (other than the
Australian Consumer Law (SA)) or a related Act.
An assurance under this section must be in writing.
A person who has given an assurance may, with the consent of the
Responsible authority, withdraw or vary the assurance at any time.
If the Responsible authority accepts an assurance, the Responsible authority must not proceed against the person who has given the assurance in respect of the conduct specified in the assurance, unless it appears to the Responsible authority that the person has acted contrary to, or has failed to comply with, the assurance.
