Offences by bodies corporate
98 Offences by bodies corporate
If a body corporate contravenes, whether by act or omission, any provision of this Act or the regulations, each person who is a member of the governing body of the body corporate or who is concerned in the management of the body corporate is taken to have contravened the same provision if the person knowingly authorised or permitted the contravention.
A person may be proceeded against and convicted under a provision pursuant to this section whether or not the body corporate has been proceeded against or been convicted under that provision.
Nothing in this section affects any liability imposed on a body corporate for an offence committed by the body corporate under this Act or the regulations.
