Variation or termination of certificate
37 Variation or termination of certificate
The Minister may vary or terminate a certificate of zero impact at any time if—
the owner or occupier, or a person acting on behalf of the owner or occupier, contravenes or fails to comply with the terms, conditions or limitations of the certificate; or
the Minister is satisfied that irrigation on the land is having an impact on waterlogging or salinisation of land or salinity levels in the River
Murray.
The Minister must serve notice of the variation or termination of the certificate on the owner and occupier of the land concerned and, subject to section 38(6), the variation or termination will take effect at the expiration of 30 days, or such longer period as is specified in the notice, after the time of service.
The notice must set out detailed particulars of the Minister's reasons for the variation or termination of the certificate.
