67 Minister's power to act in an emergency
In an emergency, the Minister may take action for the purpose of avoiding or minimising danger to human life or damage to property.
The
Minister may (for example) exercise one or more of the following powers:
take control of a harbor or harbor facility;
issue directions to the owner or operator of a vessel (including a direction to sink or destroy the vessel);
issue any other directions the Minister considers appropriate in the circumstances.
A person who—
obstructs the Minister in the exercise of powers under this section; or
fails to comply with a direction under this section, is guilty of an offence.
Maximum penalty: $10 000.
A port operating agreement may contain provisions governing the exercise of the Minister's powers under this section in relation to the port.
This section applies to, or in relation to, an excluded vessel.
