Heritage Places Act 1993

The owner of land may apply to the Council for a certificate of exclusion in respect of that land.

An application must be accompanied by the fee fixed in the regulations (which may be fixed according to the value of the land concerned).

The

Council may (in its discretion) determine whether or not to invite public submissions on the question of whether the application should be granted (but must, in deciding whether or not to invite public submissions, take into account the extent to which the criteria set out in Division 1 may apply to the relevant land).

If a certificate of exclusion is issued in respect of land, any place within the land may not be entered in the Register under this Part within five years after the date of the certificate.
