Labour Hire Licensing Act 2017

The holder of a licence must, if so required by the Commissioner by notice in writing, provide the Commissioner with such information as the

Commissioner requires relating to—

the provision of labour hire services by the licence holder;

and

whether the holder of the licence is a fit and proper person to be the holder of a licence; and

whether the licensee's business has sufficient financial resources for the purpose of properly carrying on business under the licence;

and

any other matters relating to the objects of this

Act.

The Commissioner may require the holder of a licence to provide information under subsection (1)—

on 1 or more specified occasions; or

at periodic intervals as specified by the

Commissioner.

If the holder of a licence fails to provide information in accordance with subsection (1), the Commissioner may, by notice in writing, require the holder of the licence to make good the default.

If the holder of a licence fails to comply with a notice under subsection (3) within 28 days after service of the notice, the licence is cancelled.

The Commissioner must notify the holder of a licence in writing of the cancellation of the licence under subsection (4).

The Commissioner may, in a notice under subsection (1), require the holder of a licence to verify specified information by statutory declaration.
