3 Married person has legal capacity as if not married
(1)
A married person—
(a)
has legal capacity for all purposes as if the person were not married; and
(b)
has a legal personality that is independent, separate and distinct from that of the person's spouse.
(2)
Nothing in this Act affects the generality of subsection (1).
