92 AER may make scheme pipeline determination
(1)
The AER may, on its own initiative or on the application of any person, make a determination that a non‑scheme pipeline is a scheme pipeline (a scheme pipeline determination).
(2)
An application for a scheme pipeline determination must—
(a)
be made in accordance with the Rules; and
(b)
contain the information required by the Rules; and
(c)
be accompanied by the fee prescribed by the Regulations (if any);
and
(d)
be dealt with in accordance with the Rules.
