11 Significant trees
(1)
On the designated day, a significant tree by virtue of the operation of a Development Plan under the repealed Act immediately before the designated day will be taken to be a significant tree under the
Planning and Design Code.
(2)
The
Minister may, by notice in the Gazette, amend the Planning and
Design Code in order to include a tree, or a stand of trees, in the
Planning and Design Code by virtue of the operation of
subclause (1).
(3)
Subclauses (1) and (2) do not limit the ability to make a later amendment to the Planning and Design Code in relation to a tree to which subclause (1) applies.
