A building certifier may exercise the powers of a council under this

Division in relation to—

a building owned or occupied by the Crown, or an agency or instrumentality of the Crown; or

a building in relation to which the building certifier has issued a building consent; or

a building in circumstances prescribed by the regulations.

For the purposes of the operation of subsection (1)—

a reference in this Division to a council will be taken to include a reference to a building certifier acting under subsection (1);

and

a decision of a building certifier under this Division has the same effect and is subject to appeal in the same way as a decision of the council that would otherwise be exercising the relevant function under this Division; and

a building certifier is subject to the same duties and requirements as the council that would otherwise be exercising the relevant function under this Division.
