Professional Standards Act 2004

The office of a member becomes vacant if the member—

resigns the office by instrument in writing addressed to the Minister; or

is removed from office by the Minister under this clause; or

is absent from 4 consecutive meetings of the Council of which reasonable notice has been given to the member personally or in the ordinary course of post unless—

the member is so absent on leave granted by the Council; or

before the expiration of 4 weeks after the last of those meetings, the member is excused by the Council for having been absent from those meetings; or

becomes an insolvent under administration within the meaning of the Corporations Act 2001 of the Commonwealth; or

is convicted in South Australia of an offence that is punishable by imprisonment for life or for a term of 12 months or more, or is convicted elsewhere than in South Australia of an offence that, if committed in South Australia, would be an offence so punishable.

The Minister may remove a member from office—

for incompetence or misbehaviour; or

for mental or physical incapacity to carry out duties of office satisfactorily; or

for breach of, or non-compliance with, a condition of appointment.
