Public Sector (Data Sharing) Act 2016

The Minister may delegate any of the Minister's functions or powers under this Act.

A delegation—

may be made—

to a particular person or body; or

to the person for the time being occupying a particular office or position; and

may be made subject to conditions or limitations specified in the instrument of delegation; and

if the instrument of delegation so provides, may be further delegated by the delegate; and

is revocable at will and does not derogate from the power of the Minister to act in any manner.

The Minister must—

as soon as practicable after delegating a function or power under subsection (1), cause notice of the delegation to be published in the Gazette; and

within 6 sitting days of delegating a function or power under subsection (1), cause notice of the delegation to be laid before each House of Parliament.

A notice under subsection (3) must specify—

the delegate and the delegated functions or powers; and

any conditions or limitations imposed on the delegation; and

whether the instrument of delegation provides for further delegation by the delegate.
