19 Excess employees (section 53 of Act)
If an employee's remuneration level is reduced under section 53(1)(a) of the Act, the employee is, in the absence of an award or enterprise or industrial agreement covering the matter, entitled to be paid for such a period and subject to such conditions as may be determined by the
Commissioner—
(a)
additional salary so that the employee's salary is the same as that payable before the reduction of the remuneration level; and
(b)
such allowances and monetary or other benefits (if any) as may be determined by the Commissioner having regard to the employee's remuneration and other benefits before the reduction of the remuneration level.
