23 Use or handling of radioactive material
A natural person must not use or handle radioactive material unless authorised to do so by a radiation use licence granted by the Minister under this Act. Maximum penalty: Maximum penalty: $50 000.
Subsection (1) does not apply to a person or substance of a prescribed class.
If the owner of radioactive material causes, suffers or permits the radioactive material to be used or handled by a person who is required to hold, but does not hold, a radiation use licence authorising the person to use or handle the radioactive material, the owner is guilty of an offence. Maximum penalty: Maximum penalty:
in the case of a body corporate—$250 000;
in the case of a natural person—$50 000.
The Minister must not grant a licence authorising the use or handling of radioactive material unless satisfied that the applicant has appropriate knowledge of the principles and practices of radiation protection to carry on the activities proposed to be carried on by the applicant under the licence.
