96E Exemptions
The Chief Public Health Officer may, by notice in writing, grant an exemption from this Part or specified provisions of this Part—
in relation to a specified child or children of a specified class;
or
to specified persons or persons of a specified class;
or
in relation to specified early childhood services or early childhood services of a specified class.
An exemption under subsection (1) may—
be subject to such conditions as the Chief Public Health Officer thinks fit; and
apply for a specified period, until further notice or indefinitely;
and
vary according to the circumstances to which it is expressed to apply.
The Chief Public Health Officer may, by subsequent notice in writing—
vary or revoke an exemption;
vary or revoke a condition of an exemption or attach new conditions to an exemption;
vary the circumstances to which an exemption is expressed to apply.
A person who contravenes or fails to comply with a condition of an exemption imposed under this section is guilty of an offence. Maximum penalty: Maximum penalty: $30 000.
