50 Confused Boundary Areas
Subject to subsection (2), the Surveyor‑General may, by notice in the Gazette, declare that a specified area within the State is a
Confused Boundary Area.
The Surveyor‑General may make a declaration under subsection (1)—
on the application of—
the Registrar‑General; or
the Commissioner for Highways; or
a council; or
on his or her own motion.
However, a declaration under subsection (1) may only be made if the
Surveyor‑General is satisfied that, generally, the occupation of land within the area does not accord to a substantial extent with the boundaries of land as shown in records or plans kept in the Lands Titles Registration
Office.
A notice under this section may be varied or revoked by subsequent notice in the Gazette.
