19 Power to make rules
TAFE SA may make rules for all or any of the following purposes:
to provide for the formation of an association of students, or students and staff, of TAFE SA for the purposes of promoting the interests of students or of students and staff;
to provide for matters relating to residential accommodation for students;
to provide a scheme for disciplinary action against students, including review of a decision to take disciplinary action;
to set standards relating to—
student admission and selection; or
staff behaviour or conduct; or
academic standards applicable to staff or students;
to provide monetary penalties for contravention of a rule;
to provide for any other matter affecting the administration of
TAFE SA.
A copy of the proposed rules is to be sent to each director at least 7 days before the meeting of the Board at which the rules are to be considered.
Rules made by TAFE SA—
take effect on a day specified by the Board in the rule;
and
must be made publicly available on a website determined by the
Board.
The Legislative Instruments
Act 1978 does not apply to or in relation to a rule made under this section.
A monetary penalty imposed for contravention of a rule is a debt due to TAFE SA and is recoverable by TAFE SA by action in a court of competent jurisdiction.
A rule cannot take away or restrict civil or criminal liability under another Act or at common law.
