Special authority for unregistered person to teach
30 Special authority for unregistered person to teach
The
Teachers Registration Board may, on application by a person who is not a registered teacher, in its discretion, grant the applicant a special authority to teach for a period and subject to conditions specified by the Board (which must include conditions limiting the places or circumstances in which the person may teach under the special authority).
It is a condition of every special authority that a working with children check be conducted in relation to the person at least once in each 5 year period.
Without otherwise limiting the discretion of the Board under subsection (1), the Teachers Registration Board may only grant a person a special authority if—
the person is not a prohibited person under the Child
Safety (Prohibited Persons) Act 2016;
and
a working with children check has been conducted in relation to the person within the preceding 5 years; and
the person consents to the conduct by the Board of a criminal record check relating to the person; and
the person is otherwise a fit and proper person to be granted a special authority to teach; and
the person has met any other requirements prescribed by regulation for the purposes of this subsection.
An application for a special authority must—
be made to the Teachers Registration Board in the manner and form approved by the Board; and
be accompanied by evidence of a kind determined by the Board that a working with children check has been conducted in relation to the person within the preceding 5 years; and
be accompanied by the prescribed fee.
An applicant for a special authority must pay, in addition to the prescribed fee, an amount specified by the Teachers Registration
Board, being an amount payable by the Board for the conduct by the
Board of a criminal record check relating to the applicant.
An applicant for a special authority must provide the Teachers
Registration Board with any information required by the Board for the purposes of determining the application, verified, if the Board so requires, by statutory declaration.
The
Teachers Registration Board may, in its discretion and without any requirement for a hearing or other process, by written notice to the holder of a special authority, vary or revoke the special authority.
