133 Eligibility criteria
(1)
The authorising authority must not issue a WHS entry permit to an official of a union unless the authorising authority is satisfied that the official—
(a)
is an official of the union; and
(b)
has satisfactorily completed the prescribed training; and
(c)
holds, or will hold, an entry permit under—
(i)
the
Fair Work Act; or
(ii)
the
Fair
Work Act 1994.
(2)
For the purposes of subsection (1)(c)(ii), a person who has a right of entry to a workplace under section 140 of the Fair
Work Act 1994 will be taken to hold an entry permit under that Act.
