44 Insurance and superannuation for persons with disabilities
A person may discriminate against another person on the ground of disability in the provision of services relating to any annuity or insurance or superannuation if the discrimination – is based on actuarial, statistical or other data from a reliable source; and is reasonable having regard to that data and any other relevant factors.
Subsection (1) only applies if a person discloses to the Tribunal, when required to do so – the sources on which the data are based; or the relevant factors on which the discrimination is based.
