128 How referrals to be made to Tribunal
A person who may refer a matter to the Tribunal under this Act may only refer the matter by filing with the Registrar an application, in the approved form, for referral.
If an application for referral is filed with the Registrar under subsection (1), the Registrar must, as soon as practicable – forward the application to the Tribunal; and arrange a time and a place for the hearing and determination by the Tribunal of the application; and notify the parties of the time and place for the hearing and determination of the application by the Tribunal.
The Tribunal may, in its discretion, by notice to a person, join the person as a party to a proceeding if the Tribunal is satisfied that that person has a sufficient interest in the matter to which the application for referral relates.
The Registrar must notify each party to a proceeding if another party is joined to the proceeding under subsection (3).
