94 Reference to Tribunal of refusal of Commissioner to pay weekly payments
A person – in relation to whom the Commissioner has made a determination under section 70(1)(a) that the person is entitled to compensation; and who is aggrieved by a decision made by the Commissioner that the person is not entitled to weekly payments – may refer the matter to the Tribunal.
If a decision made by the Commissioner that a person is not entitled to weekly payments is referred to the Tribunal under subsection (1), the Tribunal may determine the matter by making a decision in relation to the matter that the Commissioner may make under this Act.
A decision made by the Tribunal in accordance with subsection (2) is to be taken to be a decision made by the Commissioner under this Act, except that the decision may not be referred to the Tribunal.
