125 Permit holder may make submissions about cancellation
Before cancelling a permit, a relevant decision-maker must – give written notice to the permit holder of the relevant decision-maker’s intention to cancel the permit and the proposed grounds for doing so; and invite the permit holder to make a submission about the proposed cancellation to the relevant decision-maker within the specified period; and take into account any submission made to the relevant decision-maker by the permit holder before the deadline for the making of a submission.
For the purposes of subsection (1)(b), the specified period is not to be a period that is less than 28 days from the date the notice is given to the permit holder under that subsection.
The relevant decision-maker is not required to give notice under this section of a proposed cancellation if – the permit is a group permit; or the permit is suspended and either – the permit holder was given an opportunity to make a submission about the suspension before the suspension took effect; or the permit holder was given an opportunity to make a submission about the suspension after the suspension took effect, and the period specified by the relevant decision-maker for making that submission has ended.
