Biosecurity Act 2019

In this Division – owner, in relation to a thing, includes any person entitled to possession of the thing.

For the purposes of this Division, the continued retention of a seized thing in custody is no longer justified if – it is not, or is no longer, necessary to retain the thing to assess, prevent, eliminate, minimise, control or manage a biosecurity risk posed by or in relation to the thing; and it is not, or is no longer, necessary to retain the thing as evidence of an offence.
