Civil Liability Act 2002

Nothing in Part 9 protects a person from civil liability arising under this Part or places any restriction or limitation on an award of damages made in pursuance of this Part.

A person is not prevented from seeking compensation under Divisions 2 and 3 in respect of the same child abuse, within the meaning of section 49J(3), but, in such a case, an award of damages under either of those Divisions must take into account any award already made under the other Division.
