30 Destruction of records on acquittal
Any biometric data collected, photographs or images taken and electronic or other records made under regulation 29 are to be destroyed as soon as practicable after the release or acquittal of the prisoner or detainee if –
the detainee is released without conviction by a court; or the prisoner is acquitted of the charge or offence in respect of which he or she was imprisoned; or in the case of a migration detainee, he or she is released under the Migration Act 1958 of the Commonwealth.
