38 Application to file indictment
An application by a private prosecutor for leave to file an indictment is to be made by application.
An application under subrule (1) is to be – supported by an affidavit setting out the facts in respect of which it is made; and served on the person sought to be prosecuted, the Director and such other persons as the judge may direct; and filed in the Court and heard at such time and in such manner as the judge may direct.
