38 Termination of lease in consequence of mining operations
Where the Minister is satisfied that, by reason of any mining operations being carried out under the Mineral Resources Development Act 1995 in, on, or under any land which is subject to a lease granted by the Minister under this Act, that land cannot reasonably be used for the purposes for which it is authorised to be used under the lease, he shall, on the application in writing of the lessee, cancel the lease as to the land affected by those operations.
Section 37(2) and (3) shall have effect in respect of the cancellation of a lease under this section as they have effect in respect of the cancellation of a lease under that section.
