108 Urgent situations
An authorised officer or an electricity officer may apply to a justice for a warrant by telephone, facsimile or other prescribed means if the officer considers the urgency of the situation requires it.
The justice may complete and sign a warrant in the terms referred to in section 107(3) if satisfied that there are reasonable grounds for issuing the warrant urgently.
The justice is to – tell the officer – the terms of the warrant; and the date on which, and the time at which, the warrant was signed; and the date on which, and the time at which, the warrant ceases to have effect; and record on the warrant the reasons for granting the warrant.
The officer is to – complete a form of warrant in the same terms as the warrant signed by the justice; and write on the form – the name of the justice; and the date on which, and the time at which, the warrant was signed; and send the justice the completed form of warrant not later than the day after the warrant is executed or ceases to have effect.
On receipt of the form of warrant, the justice is to attach it to the warrant the justice signed.
A form of warrant completed by an authorised officer or an electricity officer under subsection (4) has the same force as a warrant signed by the justice under subsection (2).
