30 Notice to landowner
If an environmental site assessment is being carried out in respect of a storage system, an infrastructure owner of the storage system must notify a landowner in respect of the storage system, in writing, within 7 days after an environmental site assessment in respect of the storage system is commenced, that – the environmental site assessment is being carried out in relation to the parcel of land on which the storage system is situated; and part or all of the parcel of land on which the storage system is situated may be a contaminated site. Fine not exceeding 100 penalty units.
It is a defence in proceedings for an offence under subregulation (1) if the defendant establishes that he or she knew, or reasonably believed, that a landowner had already been notified in accordance with that subregulation.
