Forensic Procedures Act 2000

For the purposes of section 34D(1), a police officer may apply to a magistrate for an order authorising the carrying out of a sampling procedure on a young child.

An application under subsection (1) must – be in writing; and be supported by evidence on oath, or an affidavit, dealing with the matters referred to in section 34I(7); and specify the purpose or purposes, as set out in section 34J(1), for which the sampling procedure is required to be carried out on the young child; and specify the type of sampling procedure sought to be carried out on the young child.
