Powers of Minister on appeal
93 Powers of Minister on appeal
On an appeal under this Division against a decision made under section 89, the Minister may – confirm the decision under appeal; or set aside the decision and substitute another decision; or set aside the decision and remit the matter to the Director with any directions that the Minister thinks fit.
The Minister may make ancillary directions to deal with incidental matters that the Minister thinks fit.
No appeal lies from the decision of the Minister on an appeal and, if this section applies to the Tribunal by virtue of section 94(2), section 136 of the Tasmanian Civil and Administrative Tribunal Act 2020 does not apply in relation to a decision of the Tribunal in relation to the appeal.
