Expiration of guardianship orders
24 Expiration of guardianship orders
A guardianship order has effect for 3 years, or such shorter period as the Tribunal may specify in the order, unless the order is continued under section 68.
In determining the duration of an order, the Tribunal must take into account the following:the likelihood of improvements to the represented person’s decision-making ability; the prospect that changes to circumstances, including interventions to establish support arrangements, will mitigate the need for a guardian; the requirement that the order to be made be that which is the least restrictive of the person’s freedom of decision and action as is possible in the circumstances.
