Revoking advance care directive where person has decision-making ability
35Y Revoking advance care directive where person has decision-making ability
A person giving an advance care directive may revoke the advance care directive at any time in the prescribed manner if the person has decision-making ability in respect of that decision and understands the consequences of revoking the advance care directive.
On revoking an advance care directive, the person who revoked the advance care directive must, as soon as is reasonably practicable, take reasonable steps – to advise each person appointed as the person’s enduring guardian of the revocation; and to notify each other person or organisation that has been given a copy of the advance care directive of the revocation; and in the case of an advance care directive that has been registered, notify the Tribunal of the revocation.
If a person gives an advance care directive, any previous advance care directive given by the person is revoked.
