Sale of premises before cost of subdivision is determined
42 Sale of premises before cost of subdivision is determined
If premises are erected by Homes Tasmania on a lot in a subdivision, the premises, together with the lot on which they are erected, may be sold, even if the cost of subdivision has not been finally determined.
For the purposes of this section, the purchase-price of residential premises, together with the lot on which they are erected, is to be the sum that Homes Tasmania certifies to be the best estimate of the capital cost of the residential premises and lot that can be made at the time of sale and that, in the opinion of Homes Tasmania, should be sufficient to ensure that the sale does not result in a capital loss.
For the purposes of this section, the purchase-price of premises, other than residential premises, together with the lot on which they are erected, is to be the sum that Homes Tasmania determines, being a sum that is at least sufficient to ensure that the sale does not result in a capital loss.
