Schedule 4 Membership of Joint Standing Committee on Integrity
Section 23(5)
1. Vacancies
The office of a member of the Joint Committee becomes vacant for any reason that would vacate his or her seat as a member of the Legislative Council or House of Assembly, as the case may be.
Where a vacancy occurs in the office of a member of the Joint Committee, it is to be filled by appointment as provided in section 23(4) within the next 10 sitting-days of the House of Parliament by which he or she was appointed as a member of the Joint Committee.
If a vacancy occurs when Parliament is not in session, the Governor may appoint a Member of the House of Parliament to temporarily fill the vacancy until it is filled as provided in section 23(4).
2. Proceedings of Joint Committee There is to be a chairperson and vice-chairperson of the Joint Committee, who is to be elected by the members of the Joint Committee at the first meeting of the Joint Committee or as soon after the first meeting as is practicable.
3. Secretary of Joint Committee The President of the Legislative Council and the Speaker of the House of Assembly jointly are to appoint an officer of one of the Houses of Parliament to be the secretary of the Joint Committee.
4. Membership of Joint Committee not an office of profit The office of a member of the Joint Committee is not an office of profit or emolument within the meaning of the Constitution Act 1934 and the acceptance and holding of such an office does not –
render the holder of the office incapable of sitting or voting as a member of either House of Parliament; or
make void the election of the holder of the office as a member of either House of Parliament.
